Applying for Social Security Disability (SSD) benefits can be overwhelming, especially while you’re dealing with a serious injury or other medical condition. Fortunately, understanding the steps involved can make applying for the benefits you need easier, and an experienced Indiana disability attorney can handle your case for you.
Determining Eligibility
Before applying, the first step is to check whether you meet the eligibility requirements. To qualify for benefits, you must have a medical condition or blindness that prevents you from working and is expected to last for at least one year, or that will result in death. Additionally, you must have earned enough work credits through employment to qualify for Social Security Disability benefits.
If you have limited income and no recent work history, you may be able to apply for Supplemental Security Income (SSI) instead. Both programs have similar medical but different financial requirements.
Gathering Necessary Documents
Before you can submit your application, you need to gather your medical records, employment history, and financial documents. By providing accurate and up-to-date medical, employment, and financial information, you’ll increase your chances of a successful application.
Applying Online, Over the Phone, or In Person
The three primary options for applying for SSD benefits are through the online portal, by scheduling a phone call, or by scheduling an in-person meeting. Applying online is often the most convenient because you can do so from the comfort of your home. However, speaking with a Social Security representative over the phone or in person can help alleviate some of the challenges of applying.
Awaiting a Decision
Once you’ve submitted your application, the Social Security Administration will check to see if you meet the nonmedical requirements. They’ll then send your case to a Disability Examiner to determine whether your condition meets the SSA definition of a disability. At this point, the Disability Examiner may request additional medical information.
After your initial application, it typically takes five to eight months to hear back about your case. You can check the status of your application online and see the estimated wait time.
How an Indiana Disability Attorney Can Help
Working with a disability attorney can make your case go significantly smoother. Your attorney will gather the medical and financial evidence you need for your application, handle the application process on your behalf, and advocate for your rights if your case is delayed or denied.
Many Social Security applications are denied at first, and a lawyer can help you through the appeals process and represent you at hearings. Most disability lawyers also work on a contingency fee basis, which means you only pay when they secure compensation for you.
